FUNKTIONEN
Reporting to the General Counsel will be responsible for providing pragmatic and timely counsel to all business and functional units on any relevant legal, transactional, and commercial matter.
He/she will serve as legal and business ethics and integrity partner within the company, across Spanish, German, and Portuguese offices.
He/she will focus on prevention and management of risks, the development of procedures and policies that serve as a guide for the business.
RESPONSIBILITIES:
Provide comprehensive and high-quality legal advice in the areas of commercial, sales, marketing, R&D, operations, medical affairs and regulatory.
In that regard, draft, review and negotiate contracts (licensing agreements, supply agreements, distribution agreements, agency agreements, clinical trials (CROs), services agreements, manufacturing agreements (CMOs), technology transfer agreements, lease agreements …) for each area of responsibility.
Develop a culture of business ethics and integrity through the development of a best practices framework by implementing written policies, procedures, standards of conduct and conducting effective training and education.
Collaborate and counsel key stakeholders to ensure compliance with laws, regulations, and guidance.
Proactively identify emerging legal and compliance risks, develop, and lead appropriate plans to address, manage and minimize such risks.
Implement General Data Protection Regulation.
Contribute to enhance Legal Team alignment and effectiveness and to determine and pursue team’s objectives and outcomes.
EDUCATION/EXPERIENCE REQUIREMENTS:
Law Degree.
Minimum of 10 years of legal experience with significant in-house working experience in the pharmaceutical and/or biotech industry.
Specialization in Data Privacy Law or Competition Law will be highly valued.
Fluent English and Spanish. German will be highly valued.
ADDITIONAL EXPERIENCE/REQUIREMENTS:
The ideal candidate must have a deep understanding of healthcare and privacy laws.
Broad based knowledge of general corporate law and solid work experience with regulatory matters, healthcare legislation and regulations related to the promotion of pharmaceutical products and in review of promotional and non-promotional materials.
Solid judgment and business acumen and understanding of business operations, particularly in determining the significance of legal matters in the context of business objectives, assessing risks and benefits, and providing innovative business and legal solutions.
Well organized with the ability to multitask, prioritize, and manage shifting responsibilities in a dynamic, cross-functional teamwork environment.
Strong communication and collaboration skills, be proactive, and be able to work independently in a fast-paced and dynamic environment.
Strong verbal and written skills with the ability to explain complex and challenging issues in a clear manner to all levels of the organization.
Persuasive negotiator and ability to influence internal and external stakeholders.
Strong interpersonal skills, including diplomacy and flexibility.
Ability to maintain high level of integrity of confidential and sensitive information and credibility within the organization.
Ability to travel as needed - domestic and international.
